1. Acceptance of Terms & Eligibility

These Terms of Service ("Terms") constitute a legally binding agreement entered into between you ("User", "you", or "your") and PixiTools ("we", "us", or "our"), governing your access to and use of the website located at pixitools.com, including all associated software, browser tools, mobile interfaces, and application programming interfaces (APIs).

By accessing our platform, clicking "Create Account", or utilizing any utility, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

You represent and warrant that you are at least 18 years of age (or the age of legal majority in your jurisdiction) and possess the full legal capacity to enter into these Terms.

2. Description of Services & Architecture

PixiTools provides high-performance, lightweight digital utilities designed for productivity, data sanitization, document verification, format conversion, and media optimization.

A. Client-Side Browser Utilities

Most tools on PixiTools (such as the AI Image Metadata Remover, PDF Password Remover, code formatters, and checksum calculators) execute directly within your browser's local sandbox using JavaScript and WebAssembly. Your files are processed using your machine's CPU/GPU and are not uploaded to our servers.

B. Server-Assisted Verification Utilities

Certain specialized compliance services—such as the e-Aadhaar Digital Signature Verifier—require temporary server-side cryptographic processing to evaluate government root certificates and digital signatures. In accordance with our Privacy Policy, these files are held strictly in temporary volatile memory and are irreversibly auto-purged within 15 minutes of generation.

3. Intellectual Property & Content Ownership

We maintain a strict separation between our platform assets and your personal data:

• Your Content Remains 100% Yours: You retain complete ownership, copyright, and intellectual property rights over all images, documents, text snippets, or code you process using PixiTools. We claim zero proprietary interest, license, or right to reuse your uploaded or processed files.
• PixiTools Platform IP: The PixiTools brand name, visual design, custom logos, source code, CSS stylesheets, UI components, documentation, and algorithms are the exclusive property of PixiTools and are protected under international copyright, trademark, and unfair competition laws.
• Feedback: If you submit feedback, suggestions, or bug reports, you grant us a non-exclusive, royalty-free, perpetual license to use and implement such feedback to improve our services without any obligation of compensation.

4. Acceptable Use Policy & Prohibited Conduct

You agree to utilize PixiTools strictly for lawful purposes and in accordance with these standards. You shall NOT:

• Engage in unauthorized automated scraping, mass data harvesting, or automated continuous querying that degrades service quality for other users without prior written consent.
• Attempt to bypass, disable, circumvent, or interfere with rate-limiting controls, daily quota trackers, authentication mechanisms, or security filters.
• Upload, verify, or process documents containing malicious payloads, viruses, worms, Trojan horses, or corrupted data designed to compromise server integrity.
• Use PixiTools to process, create, or distribute unlawful, defamatory, harassing, or fraudulent materials, or to forge digital identity credentials.
• Decompile, reverse engineer, disassemble, or derive the backend source code of proprietary server-side validation endpoints.

5. User Accounts & Security

You may browse and use many of our tools anonymously without creating an account. If you elect to register an account or subscribe to PixiTools Pro:

• You agree to provide accurate, current, and complete registration information.
• You are solely responsible for maintaining the confidentiality of your credentials and password, as well as for all activities that occur under your account.
• You must notify us immediately at [email protected] upon discovering any unauthorized access or breach of security.
• You may delete your account at any time via your Account Dashboard, which will permanently expunge your credentials and profile records.

6. Subscriptions, Payments & Billing (PixiTools Pro)

We offer both free tier access and optional premium recurring membership plans ("PixiTools Pro"):

• Pricing & Billing Cycles: Current pricing and features are detailed on our Pricing Page. Subscriptions are billed in advance on a recurring monthly or annual basis until cancelled.
• Payment Processors: Payments are processed securely via certified third-party payment gateways (such as Razorpay / Stripe). We do not store raw credit card numbers on PixiTools servers.
• Auto-Renewal: Your subscription renews automatically at the end of each billing term unless cancelled prior to the renewal date.
• Cancellation: You may cancel your Pro subscription at any time directly through your dashboard. Following cancellation, you will retain Pro benefits until the conclusion of your current paid billing period.
• Refund Policy: Due to the digital and immediate availability of our Pro benefits, fees are generally non-refundable once a billing cycle begins, except where required by mandatory local consumer protection laws or in cases of demonstrable system billing errors.

7. Advertising & Free Tier Operations

Free tier users acknowledge that PixiTools displays contextual advertisements through Google AdSense to offset server, domain, bandwidth, and maintenance overheads.

Users who upgrade to PixiTools Pro receive an ad-free interface wherein third-party advertising scripts and banner units are disabled.

8. Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

To the maximum extent permitted by applicable law, PixiTools disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

Specifically, we do not warrant that:

• The utilities will operate uninterrupted, error-free, or completely secure from external cyber attacks.
• The outputs of algorithmic tools (such as metadata removal or file format conversion) will be 100% compatible with every legacy external third-party software.
• Cryptographic verification reports generated by signature tools will substitute for formal government-certified digital forensics in legal proceedings.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW, IN NO EVENT SHALL PIXITOOLS, ITS OPERATORS, DIRECTORS, AFFILIATES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES (INCLUDING DAMAGES FOR LOSS OF PROFITS, DATA, USE, GOODWILL, OR BUSINESS INTERRUPTION) ARISING OUT OF OR IN CONNECTION WITH YOUR USE OR INABILITY TO USE THE PLATFORM.

IN NO EVENT SHALL PIXITOOLS' AGGREGATE LIABILITY ARISING UNDER THESE TERMS EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT PAID BY YOU TO PIXITOOLS IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM; OR (B) $50.00 USD (OR LOCAL CURRENCY EQUIVALENT).

10. Indemnification

You agree to defend, indemnify, and hold harmless PixiTools, its developers, operators, and agents from and against any third-party claims, liabilities, damages, losses, and reasonable legal expenses arising out of or in any way connected with: (a) your access to or misuse of the platform; (b) your violation of these Terms; or (c) your infringement of any intellectual property or privacy rights of any third party.

11. Service Modifications & Account Termination

We reserve the right to modify, suspend, or discontinue any utility or feature on PixiTools at any time with or without prior notice.

We reserve the right to suspend or terminate your account or deny platform access immediately, without prior notice or liability, if you violate these Terms or engage in conduct that harms the platform, other users, or third parties.

12. Governing Law & Dispute Resolution

These Terms and any dispute arising out of or related to your use of PixiTools shall be governed by and construed in accordance with the laws of India, without giving effect to any conflict of law principles.

Any legal action, suit, or proceeding arising under or relating to these Terms shall be instituted exclusively in the competent courts located in Kolkata, West Bengal, India, and you hereby consent to the personal jurisdiction and venue of such courts.

13. Policy Amendments & Severability

We may update these Terms periodically. When changes are posted, we will update the "Effective Date" at the top of this page. Your continued use of PixiTools following the posting of revised Terms indicates your acceptance of such modifications.

If any provision of these Terms is deemed unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions.
